On Monday, September 21, 2020, at the request of Luzerne County District Attorney Stefanie Salavantis, the Office of the United States Attorney Middle District, along with the Federal Bureau of Investigations, Scranton Resident Office, began an inquiry into reports of potential issues with a small number of mail-in ballots at the Luzerne County Board of Elections.

In a Thursday press release, U.S. Attorney David Freed confirmed that a small number of military ballots had been discarded.

Over the past week, the FBI, working in conjunction with the Pennsylvania State Police were able to recover nine discarded military ballots, at this time. Of the nine recovered ballots, seven were cast for President Donald Trump. Two of the discarded ballots had been resealed inside their appropriate envelopes by Luzerne elections staff prior to recovery by the FBI. The contents of those two ballots are unknown.

U.S. Attorney Freed says the investigating agencies have been conducting numerous interviews and have been able to recover and review certain physical evidence. He also confirmed reports that election officials in Luzerne County have been cooperative with the investigations.

One inquiry remains ongoing, but is expected to be concluded shortly. Upon completion, the results of the inquiries will be shared with Luzerne County officials.

U.S. Attorney Freed’s press release concluded by stating “It is the vital duty of government to ensure that every properly cast vote is counted.
