Kansas Senate President disputes governor's right to nominate Court of Appeals judge

A fight is brewing in Topeka over whether the Kansas governor is authorized to nominate another judge to the Court of Appeals. 

Gov. Laura Kelly is moving ahead with plans to nominate a new Kansas Court of Appeals judge despite a dispute over whether she has the authority to do it. She withdrew her first choice of Labette County District Judge Jeffry Jack last month because of highly-partisan political posts on Jack's Twitter feed from 2017. 

Kelly failed to nominate someone properly on time and the task now falls to the Kansas Supreme Court Chief Justice, said Susan Wagle, Senate President.

Attorney General Derek Schmidt is asking the Supreme Court to decide who is right in the dispute.
